TERMS & CONDITIONS
By accessing and using the Dressed By ES website at www.dressedbyes.com, you are accepting and consenting to the practices in these terms and conditions. Dressed By ES reserves the right to change these terms and conditions from time to time at its sole discretion.
If your booking was placed through All The Dresses, a dress hire marketplace we partner with, the terms agreed on their website when you checked out will apply. You should check your order confirmation email or visit their website for terms & conditions rather than reading the terms on this page.
DEFINITIONS
In these Terms & Conditions, “you” and “your” refer to all users of this Website, including customers who place a booking through www.dressedbyes.com.
“Dressed By ES”, “we”, “us” and “our” refer to Dressed By ES (ABN 89 737 617 043).
CONTRACT
These Terms & Conditions constitute a binding legal agreement between you and Dressed By ES.
These Terms apply to all users of this Website, whether you are browsing or placing a booking. The Terms & Conditions in effect at the time you place your order apply to that booking.
Dressed By ES may update or revise these Terms from time to time. Updated Terms will be published on the Website and will apply to any future use of the Website or future bookings made after publication.
Certain areas of the Website, promotional offers, or specific services may be subject to additional terms or guidelines. Where applicable, you agree to comply with those additional terms in conjunction with these Terms & Conditions.
By placing a booking through www.dressedbyes.com, you acknowledge and agree that:
- You are renting the products only and ownership remains with Dressed By ES at all times.
- You are over 18 years of age.
- You are authorised to use the selected method of payment.
Garments may be worn by individuals under 18 years of age; however, bookings must be made by an adult who accepts full responsibility for the hire.
By clicking “I accept” or proceeding with checkout, you confirm that you have read, understood and agreed to these Terms & Conditions.
PAYMENT TERMS
The hire fee includes the rental fee, Australia Post Express delivery (including Express return shipping), professional cleaning after hire, and any additional charges listed on the website in relation to your booking.
By entering into this agreement, you authorise Dressed By ES to charge your nominated payment method in accordance with these Terms & Conditions.
You confirm that:
- You are authorised to use the selected payment method; and
- The payment details provided are accurate and complete.
You authorise Dressed By ES to charge your nominated payment method for any additional amounts payable under this agreement, including but not limited to:
- Late return fees
- Additional cleaning charges where applicable
- Repair costs
- Replacement costs
- Loss of hire income resulting from late return, damage, or non-return
If a charge cannot be successfully processed, we will issue an invoice for the outstanding amount. You agree to pay any invoiced amount within five (5) working days.
If payment for an order is reversed, declined, cancelled, or subject to chargeback after the Rental Item has been dispatched, you remain liable for the full hire fee and any additional charges payable under this agreement.
Failure to pay any outstanding amount within 48 hours of written demand may result in cancellation of current or future bookings and referral of the debt to a recovery agency. You acknowledge that any reasonable costs incurred in recovering outstanding amounts (including debt collection or legal costs) may be added to the amount owed.
You agree that you will not initiate a chargeback or payment dispute where Dressed By ES has fulfilled its obligations under these Terms & Conditions.
IDENTIFICATION
Dressed By ES may request photo identification, verification of payment details, or other documentation at our discretion for fraud prevention and security purposes.
If requested, you must provide the required identification promptly. Failure to provide the requested information may result in refusal or cancellation of your booking.
If we are unable to fulfil your hire or deliver the Rental Item on time due to your failure to provide requested identification or verification, you will not be entitled to a refund. In such circumstances, a store credit may be issued at our discretion.
TITLE TO RENTAL ITEMS
All Rental Items remain the sole property of Dressed By ES at all times.
You acknowledge that you are hiring the garment only and that no ownership rights are transferred to you under this agreement.
Dressed By ES reserves the right to recover or retrieve a Rental Item where it has not been returned in accordance with these Terms & Conditions.
You must not alter, modify, hem, repair, iron, or otherwise interfere with the garment without the prior written consent of Dressed By ES.
BOOKING PERIOD
Dressed By ES offers standard rental periods of four (4) or eight (8) days. The hire period is inclusive.
This means the day your garment is delivered counts as Day 1 of your hire, and the day you are required to return the garment counts as the final day of your hire.
For example, for a 4-day hire:
• Delivery Friday (Day 1)
• Return Monday (Day 4)
Both Friday and Monday are included within the 4-day hire period.
The garment must be lodged over-the-counter at Australia Post before 4:00pm on the final day of your hire.
DELIVERY
When placing a booking, you are required to select a “Delivery Date”. You should select a Delivery Date that is one (1) or two (2) days before the date you intend to wear the garment.
Wednesday start dates are not available, as 4-day hires cannot be returned on a Saturday.
All Rental Items are shipped via Australia Post Express to the delivery address provided at checkout. Tracking details will be sent to your nominated email address once your order has been dispatched.
Our standard postage rate of $19.95 includes Express delivery to you and Express return shipping for items within the same booking.
Postage is calculated per booking period. If you are hiring garments for different dates or separate weekends, you must place separate orders, and the applicable postage fee will apply to each booking. We are unable to combine bookings with different hire dates into a single postage fee.
Delivery Timing
Delivery within your suburb is determined by Australia Post. Delivery may occur between 7:00am and 8:00pm on the Delivery Date, or earlier.
Your hire period commences from the first attempted delivery.
If delivery is attempted and you are unavailable to receive the parcel, your hire period will still commence. Refunds or credits will not be provided where delivery has been attempted but you were unavailable.
Authority to Leave
By placing an order, you grant authority for your parcel to be left in a safe place at the delivery address.
If you do not wish to grant authority to leave, you must clearly specify this in the delivery instructions at checkout.
Where authority to leave is granted, responsibility for the parcel transfers to you once delivery has been made. Dressed By ES and Australia Post are not liable for parcels left unattended in accordance with this authority.
Safe Delivery & Post Office Collection
If Australia Post determines that the delivery location is not suitable for safe delivery, the parcel may be taken to your local post office.
If this occurs on a Friday, it is your responsibility to collect the parcel before post office closure.
No refund or credit will be provided where the garment cannot be worn due to failure to collect the parcel in time.
Safe delivery decisions are made by Australia Post and are outside of our control.
Incorrect Address & Access Issues
You are responsible for providing a complete and accurate delivery address, including apartment numbers, building names, company names, or any information required for successful delivery.
If delivery fails due to:
- An incorrect or incomplete address
- Failure to provide necessary delivery details
- Restricted access to the property
- Redirection requests
You will not be entitled to a refund or credit.
If a parcel is returned to sender or delayed as a result of the above, you may also be liable for late fees or replacement costs if the garment cannot be returned in time for a subsequent booking.
Redirection
Once a parcel has been dispatched, you must not request redirection through Australia Post.
Redirection significantly delays delivery and may prevent the garment from arriving in time for your event.
If you redirect the parcel and it does not arrive in time, no refund or credit will be provided.
Early Dispatch
We may dispatch your order earlier than your selected Delivery Date to minimise postal delays.
You must ensure that the delivery address provided is secure and able to accept parcels prior to your selected Delivery Date.
Postal Delays
In most cases, garments arrive on or before the Delivery Date. However, delays may occur due to circumstances outside our control, including Australia Post operational delays.
If a garment arrives after your event and you are unable to wear it, please contact us.
Where the booking was placed at least three (3) business days prior to the hire start date, we may offer:
• A refund minus postage costs ($30); or
• 110% store credit valid for six (6) months.
If the booking was placed less than three (3) business days prior to the hire start date (“last-minute order”), a credit note minus postage costs may be issued.
No refund or credit will be provided where the garment arrives later than expected but is still able to be worn to your event.
Delivery After Return Date
If a garment is delivered after your scheduled return date, you are still required to return the garment within 48 hours of delivery.
Failure to return the garment within this timeframe may result in late fees and, where applicable, replacement charges of up to 200% of the RRP.
INCORRECT OR FAULTY ITEMS
If you receive an incorrect item, you must notify us immediately at info@dressedbyes.com.
Where possible and if time permits, we will make reasonable efforts to provide a replacement garment so that you still have something suitable to wear.
If you receive the correct item but believe there is significant damage, a fault, or noticeable staining, you must:
- Notify us within four (4) hours of delivery; and
- Provide clear photographic evidence; and
- Do so prior to wearing the garment.
If the garment is worn before notifying us, we reserve the right to refuse a refund.
If notification is not received within four (4) hours of delivery, the issue may be deemed to have occurred during your hire period. Prompt notification protects both you and Dressed By ES from uncertainty regarding when damage occurred.
You acknowledge that Rental Items are not brand new and may show minor signs of wear consistent with normal rental use. Minor wear and tear does not constitute a fault and does not entitle you to a refund.
Where a significant fault is reported within the required timeframe and you seek a refund, the garment must be returned in accordance with our return instructions and within 24 hours of delivery. Refunds will be assessed once the garment has been returned and inspected.
If a refund is approved, it will include the hire fee and any postage paid, in accordance with Australian Consumer Law.
ISSUES WITH FIT OR APPEARANCE
Dressed By ES operates primarily online; however, we also offer take-home and postal try-on services (subject to availability).
Customers are encouraged to utilise a try-on service where available if they are unsure about sizing or fit.
Alternatively, we recommend trying on the same garment in-store or a similar style from the same brand, where possible. Even if the exact colour or style is sold out, trying a comparable design can assist in determining fit.
We provide sizing information, product descriptions, and imagery to assist you in selecting a suitable garment. This information is based on brand details, experience, and research; however, individual fit may vary depending on body shape, proportions, and personal preference.
By placing a booking, you acknowledge that you are responsible for selecting the size and style that best suits you and your event.
No refund or credit will be provided where:
- The garment does not fit;
- The style does not suit you;
- You change your mind; or
- The garment is not appropriate for your event.
Customers who choose not to utilise available try-on services or alternative sizing methods do so at their own discretion.
This clause does not exclude your rights under Australian Consumer Law where a garment is not as described or is significantly faulty.
USE OF GARMENTS
Garments are worn at your own risk.
Garments must be worn with reasonable care appropriate to the fabric, construction and value of the item. Customers are responsible for ensuring the garment is not subjected to conditions or activities likely to cause damage, including but not limited to excessive contact with rough surfaces, prolonged ground contact, or exposure to substances likely to cause permanent staining or fabric damage. Dressed By ES accepts no liability for damage arising from a failure to exercise reasonable care in the wear of the garment.
Dressed By ES is not liable for allergic reactions, skin sensitivities, fabric reactions, personal discomfort, or minor injuries that may arise from the normal wear of a garment.
Customers are responsible for ensuring they are comfortable wearing the selected garment and that it is appropriate for their personal circumstances.
Nothing in this clause excludes your rights under Australian Consumer Law.
CANCELLATIONS
If you cancel your booking more than thirty (30) days prior to the start date of your hire, a store credit will be issued minus a $30 cancellation fee.
Cancellations made within thirty (30) days of the hire start date are not eligible for a refund or store credit.
Store credits are valid for six (6) months from the date of issue and will expire if not used within that period.
Once a store credit has been used to make a new booking, that booking is final and not eligible for further cancellation, refund, or reissue of credit. This includes circumstances where the garment does not fit.
We understand that unexpected situations can arise. In exceptional circumstances, we may consider variations to this policy at our discretion. Please contact us to discuss your situation.
Nothing in this clause excludes your rights under Australian Consumer Law.
STORE CREDITS
Store credits:
- Are non-refundable and cannot be redeemed for cash.
- Are valid for six (6) months from the date of issue unless otherwise stated.
- Must be used in a single transaction and any remaining balance will not be retained unless required by law.
- Cannot be transferred to another person without prior written approval from Dressed By ES.
- Cannot be used in conjunction with other promotional codes unless expressly stated.
Expired store credits will not be reinstated or extended.
Nothing in this clause excludes your rights under Australian Consumer Law.
CANCELLATION FEE
A $30 cancellation fee applies to all bookings where a store credit is issued.
This fee reflects administrative costs and loss of opportunity associated with the garment being reserved and unavailable to other customers, as well as transaction and operational costs incurred in processing the booking.
For bookings placed using Afterpay, an additional $10.95 cancellation fee applies to cover non-refundable transaction fees charged by the payment provider.
CANCELLATIONS BY DRESSED BY ES
Dressed By ES may cancel a booking where we are unable to fulfil the hire due to circumstances beyond our reasonable control or where the garment is no longer available.
This may include, but is not limited to:
- The garment being returned damaged by a previous customer
- The garment being lost, stolen, or not returned by a previous customer
- A prior late return affecting availability
- Postal network disruptions or delivery delays
- Operational issues that prevent us from fulfilling the booking
In the event that we cancel your booking, you will be entitled to a full refund of all amounts paid for the hire and postage.
To the maximum extent permitted by law, Dressed By ES will not be liable for any indirect or consequential loss arising from the cancellation.
Nothing in this clause excludes your rights under Australian Consumer Law.
RETURN OF ITEMS
All Rental Items are delivered with a prepaid Australia Post Express return label.
If you do not receive a return label, you must notify us immediately.
If you lose your return label, it is your responsibility to return the garment via trackable Australia Post Express to:

You must provide tracking details and a photograph of the addressed satchel to info@dressedbyes.com to avoid late fees or replacement charges.
Standard Return Requirements
All garments must be returned:
- Over-the-counter at an Australia Post store or depot
- On or before the specified “Return on” date
- Before 4:00pm (Australia Post Express cut-off time)
Items lodged after 4:00pm are considered late.
If your return date falls on a Sunday or public holiday, you may lodge the parcel on the next business day before 4:00pm. No late fees will apply in this instance.
Yellow Street Post Boxes
If you are unable to attend an Australia Post outlet on your return date, you may lodge the parcel in a yellow Australia Post Express street post box at your own risk.
Where a parcel is placed in a street post box:
- If the parcel is lost and never scanned, you may be liable for replacement costs.
- If the parcel is scanned on a later date, the date of first scan may be used when calculating late fees.
Pick-Up Returns
If you have selected a pick-up hire, you may either:
- Return the garment to the agreed pick-up location by the agreed date and time; or
- Post the garment back at your own expense via Australia Post Express.
If posting back, the same return conditions apply, including over-the-counter lodgement before 4:00pm on the final day of hire.
Failure to return the garment by the agreed date and time may result in late fees.
CLEANING
Professional cleaning is included in your hire fee.
All garments are cleaned and prepared for each rental. No additional cleaning cost will be charged provided the garment is returned in a condition consistent with normal wear for a single event.
Normal wear does not include excessive staining, heavy soiling, strong odours, significant fake tan transfer, or marks requiring treatment beyond standard professional cleaning.
If a garment is returned in a condition requiring additional cleaning due to excessive staining or soiling, you will be responsible for the reasonable additional cleaning costs incurred.
You must not wash, dry clean, alter, hem, repair, or otherwise treat the garment yourself without prior written approval from Dressed By ES.
You may lightly steam the garment if required; however, this is done at your own risk. Dressed By ES is not responsible for any damage caused by steaming, including but not limited to water marks, heat damage, fabric distortion, stretching, or staining. Any damage resulting from steaming may result in repair or replacement charges in accordance with the Damage or Loss section of these Terms & Conditions.
Use of make up and fake tan is at your discretion. If make up and fake tan results in permanent staining that cannot be removed through professional cleaning, the Damage or Loss policy will apply.
DAMAGE OR LOSS
Reporting Pre-Existing Damage
If you believe a garment has arrived damaged, faulty, or significantly stained, you must:
- Notify Dressed By ES on the same calendar day as delivery;
- Provide clear photographic evidence; and
- Do so prior to wearing the garment.
Failure to notify us on the same day as delivery may result in the damage being deemed to have occurred during your hire period.
If a refund is sought due to damage, the garment must be posted back within 24 hours of delivery and lodged over-the-counter before the 4:00pm Australia Post Express cut-off.
Minor Damage During Hire
If minor damage occurs during your hire (such as a loose button or small stitch coming undone), please notify us and do not attempt to repair the garment yourself.
Where damage is considered minor and repairable through standard methods, a charge may not apply.
Unauthorised Alterations or Cleaning
You must not alter, hem, tape, cut, iron, wash, dry clean, repair, or otherwise treat the garment yourself without prior written approval.
Unauthorised alterations or treatment may result in you being liable for repair or replacement costs.
No damage insurance is included in your booking.
Significant Damage
If a garment is returned damaged and the damage is not considered minor wear, you will be liable for the reasonable cost of repair.
If the garment cannot be restored to a condition suitable for future hire, you may be liable for replacement.
Replacement charges may be up to 150% of the original RRP, reflecting:
• Replacement cost (where available);
• Sourcing difficulty; and
• Loss of future rental income.
Payment of any replacement amount does not transfer ownership of the garment. The garment remains the property of Dressed By ES at all times unless specified in writing by Dressed By ES.
Loss or Non-Return
If a garment is lost, not returned, or returned in an irreparable condition where a replacement cannot be sourced, you may be liable for up to 200% of the RRP.
Australia Post Loss
If a garment is lodged over-the-counter and scanned by Australia Post and is subsequently lost in transit, you will not be liable.
If the parcel is not scanned (including where it is placed in a street post box), liability for loss may remain with you.
Authorisation to Charge
By accepting these Terms, you authorise Dressed By ES to charge your nominated payment method for repair, replacement, or loss amounts where applicable. You will be notified prior to any charge being processed.
LATE RETURN
You agree to return the garment on the specified “Return on” date.
The garment must be:
- Lodged over-the-counter at an Australia Post outlet or depot;
- Using the Express return label provided; and
- Before the 4:00pm Australia Post Express cut-off.
If your return date falls on a Sunday or public holiday, the garment must be lodged on the next business day before 4:00pm. No late fee will apply in this instance.
Failure to Lodge On Time
If the garment is lodged after the final day of your hire period, late fees will apply.
If you choose to return the garment via a yellow Australia Post street post box, late fees will be calculated based on the date of the first Australia Post scan. As street post boxes are not scanned immediately, delays may occur and liability for late return remains with you.
Late Fee Calculation
Late fees are calculated at a daily rate equal to one quarter (¼) of your rental price.
For example, if your 4-day hire fee was $100, the late fee will be $25 per day.
Late fees accrue daily until the garment is lodged and scanned by Australia Post.
Impact on Subsequent Bookings
If a late return prevents a subsequent customer from wearing the garment and a refund is required to be issued, you may also be liable for the reasonable loss of that booking in addition to applicable late fees.
Authorisation
By accepting these Terms & Conditions, you authorise Dressed By ES to charge applicable late fees to your nominated payment method. You will be notified prior to any charge being processed.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Dressed By ES will not be liable for any indirect, incidental, special, or consequential loss or damage arising from or in connection with:
- Cancellation of a booking;
- Late delivery of a rental item;
- Non-delivery of a rental item;
- Issues relating to fit, style, or suitability; or
- Any delay or failure caused by circumstances outside our reasonable control.
This includes, but is not limited to, loss of opportunity, loss of income, loss of profits, loss of goodwill, emotional distress, or other consequential or economic loss.
Where liability cannot be excluded under law, Dressed By ES’ total liability will be limited to the amount paid by you for the relevant booking.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian Consumer Law.
DEFINITION OF "REFUND"
For the purposes of these Terms & Conditions, a “refund” means the return of funds to the original payment method used to complete the booking.
Where payment was made by credit or debit card, the refund will be processed back to that card.
Where payment was made using a credit note, the credit note will be reinstated. The reinstated credit will retain the original expiry date unless otherwise stated.
Where a booking was paid using multiple payment methods, refunds will be processed proportionately to each payment method used.
No refund will be provided where a garment is returned worn, unless required under Australian Consumer Law.
EVENT & PERSONAL CIRCUMSTANCES
Dressed By ES is not responsible for cancellations, postponements, venue changes, travel disruptions, illness, weather events, or any other personal or third-party circumstances that may affect your ability to wear the garment.
All bookings remain subject to our standard cancellation policy unless otherwise required by law.
FORCE MAJEURE
Dressed By ES will not be liable for any delay or failure to perform its obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to government restrictions, natural disasters, public health emergencies, or postal disruptions.
In such circumstances, bookings will remain subject to our standard cancellation terms unless otherwise required by law.
CHANGES TO THE RENTAL AGREEMENT
Dressed By ES reserves the right to amend or update these Terms & Conditions at any time.
The Terms & Conditions that apply to your booking will be those in effect at the time your order is placed.
Any amendments will apply to future bookings only and will not affect existing confirmed orders.
SOCIAL MEDIA & USER GENERATED CONTENT
By tagging @dressedbyes, mentioning Dressed By ES on social media, or submitting photographs or content to us via direct message, email, or other means, you grant Dressed By ES a non-exclusive, royalty-free licence to repost, share, and use that content for marketing and promotional purposes.
This may include use on our website, social media platforms, email marketing, and other promotional materials.
If you do not wish for your content to be used, you must notify us in writing.
Dressed By ES will not claim ownership of your content and will make reasonable efforts to credit you where appropriate.
GOVERNING LAW
These Terms & Conditions are governed by the laws of New South Wales, Australia.
You agree that any dispute arising in connection with your booking or these Terms & Conditions will be subject to the jurisdiction of the courts of New South Wales.
ENTIRE AGREEMENT
These Terms & Conditions constitute the entire agreement between you and Dressed By ES in relation to your booking and supersede any prior discussions, representations, communications, or agreements, whether written or verbal.
You acknowledge that you have not relied on any representation, statement, or promise not expressly set out in these Terms & Conditions.
